What Happened – June 7

It was on this day in 1892 that Homer Plessy was arrested while sitting in a first-class train car. He had the proper ticket, but wasn’t the proper race. Louisiana had a law that mandated segregated train cars, and a local organization wanted a “test case” to take to court. Mr. Plessy agreed to be arrested for the cause, and when he refused to leave the white-only train car that was exactly what happened. In his first court appearance the judge ruled that the state had the right to make regulations in regards to trains within their border. The State Supreme Court upheld that verdict, and it was appealed to the US Supreme Court. The highest court in the land returned a 7-1 decision (one judge sat out the case) that upheld the original ruling. This case established the doctrine of “separate but equal”, which would not be overturned until  Brown v. Board of Education in 1954.
